New website helps steer 6 million car crash victims to speedy recovery

In the wake of reduced claims and stiffer premiums required by auto insurance companies, not to mention unsatisfied attorney clients, a free new website has launched to educate consumers on the accident recovery process, including do-it-yourself techniques, settlement tips, and when to hire an attorney.

The painfully slow socialized medical care at the ER and the trick question from the adjuster

This is part of our continued coverage on my wife’s injury claim with Progressive

By the time I had showed up to the accident scene ten minutes after my wife first called me, she was already complaining of instant neck pains and a severe headache. Anytime you have head trauma, it is wise to be seen by a doctor right away. I first took her to an InstaCare, but they wanted us to pay up front for the visit. They would not bill my insurance. Because I didn’t have any cash on me, I drove her to the nearest ER.

While sitting in the ER, the adjuster from the at-fault driver called my wife. This was less than 1 hour post accident. One of the first questions he asked was, “what are your injuries?” This question only has one intention this soon after the accident. The adjuster is trying to get you to say that you are feeling fine. Most whiplash symptoms will not show up for a few hours or even days after the accident. The adrenaline is pumping so high that you probably don’t feel much pain, if anything at all, especially within the first hour of the accident and you certainly won’t know the full extent of your injury for a few weeks or even months. If you tell the adjuster that you are feeling fine, he will hold it against you for the rest of your claim. I whispered to her to tell him that she did not know the extent of her injuries and that we would call him back Monday after being seen by the ER.

How the insurance company created the personal injury attorney

While on a recent trip to southern California, I met up with an old friend who just graduated from law school. While in law school, he really enjoyed his criminal classes and decided that he wanted to be a criminal defense attorney. While I was talking with him, he told me how long his days are and how he would get calls in the middle of the night from his clients needing help because they had just been arrested for something. I began to tell him about how easy personal injury law is and why he hadn’t decided to be a PI attorney. “The money is easy and you work 9 to 5″ I told him.

He told me that the reason he had stayed away from personal injury law was because there were too many PI attorneys. It was a highly competitive industry. If you don’t believe me, open the phone book and look at how many personal injury attorneys there are.

So why are there so many personal injury attorneys? Below is the main reason there are so many attorneys and I will offer a challenge to the insurance companies to cut that number in half:

Why am I getting sued and what do I do now?

Suppose you were involved in an accident and it just so happens that you are the one at fault for causing the accident. The person that you hit was banged up pretty good, but it didn’t appear to be anything serious. You call your insurance company and report the claim and they tell you to not worry about anything and they will take care of everything for you. 6 months later and you get served a lawsuit from the attorney of the person you hit. WHAT?

All the sudden your asking yourself how did all this happen? What kind of person would sue me over what appeared to be a small accident? Why isn’t my insurance company taking care of me? What do I do now?

The jaded adjuster

The hardest thing about negotiating your injury settlement claim will be dealing with a jaded adjuster from the insurance company. You are the one that went through the hassle and troubles of the accident and the adjuster will be another piece adding to your pain and suffering. Why is it that some adjuster are such a pain in the rear to deal with?

Think about their job description: to deny any fraudulent claims and to evaluate legitimate injury claims and pay out as little as possible on those claims. Let’s break this down and give you a better understanding why the job in and of itself creates a jaded adjuster.

Top 5 tight wad insurance companies

Every insurance company is trying to make money by paying out as little as possible on injury claims. However, some insurance companies seem to routinely pay less than others. These are the main offenders:

1. Allstate: My dealings with Allstate have generally been pleasant. Most of the adjusters are good to work with and don’t play games. However, when it comes to paying out claims, Allstate takes the cake for being the biggest tight wad. If you refuse to settle on their low offers, they won’t lose any sleep over a lawsuit.

2. American Family: This one comes in a close second. In fact, they may just leap frog Allstate for the top spot shortly. You can never talk to a real person on the phone and you consistently have to leave messages that never get returned. My feelings are that the adjusters use this technique to frustrate you in to settling for less than you want to because you are so fed up with their costumer service.

Profitable insurance companies at the expense of your health

When dealing with insurance companies, you will quickly realize they are the most hypocritical companies around. The government forces you to do business with them, and yet the former requires little to no regulation. Herein lies the first part of the hypocrisy: you pay premiums because it’s the law. But the minute you make a claim, your rates go up or they drop you completely. And that’s just the beginning.

When you make an injury claim, insurance companies scrutinize your injury with a fine tooth comb. If you have any history of a similar injury in the last decade, they will try and claim it as unrelated to the accident (i.e. aggravation of an old injury). This previous injury could be years old and you could have zero symptoms, but somehow this is an old injury and not a new one caused by the negligence of their insured driver. (more…)
