If you live in a state where there is a high population of illegal aliens, chances are you or someone you know will be involved in a car crash with an illegal alien at some point in time. So, what are your rights and what rights do they have?
First, an illegal alien is entitled to every right that a legal citizen has. Our laws are written to protect the victim regardless of their legal status. This means if a legal citizen hits an illegal alien and hurts them, the illegal alien can make an insurance claim against the person that hurt them. The illegal alien can also file a lawsuit and use our court system to be fully compensated for their injuries.
Second, the legal citizen can file an insurance claim or lawsuit against an illegal alien if they are the ones negligent for the accident and hurt the legal citizen. Illegal aliens can and are expected to carry auto insurance just as a legal citizen is expected to carry auto insurance.

Here’s the deal. Someone gets in a car accident and their car gets totaled out. Instead of waiting to find out how much their 93 Ford Tempo is worth, they immediately drive to the nearest dealership and purchase a brand new Jeep Wrangler. Their reasoning, “the insurance company will have to buy me a new car because they totaled out my old one”.
Unfortunately, that’s not the way it works. Just because you had your car totaled out does not mean that the at-fault insurance company has to buy you a brand new car. While on a recent trip to southern California, I met up with an old friend who just graduated from law school. While in law school, he really enjoyed his criminal classes and decided that he wanted to be a criminal defense attorney. While I was talking with him, he told me how long his days are and how he would get calls in the middle of the night from his clients needing help because they had just been arrested for something.
